The Exhibitions & Conferences Alliance (ECA), representing the U.S. business and professional events industry, publicly welcomed a U.S. Supreme Court ruling on 20 February 2026 that found tariffs imposed under the International Emergency Economic Powers Act (IEEPA) to be unconstitutional.
According to the ECA statement, the IEEPA-based tariffs had increased costs and uncertainty for event organizers, suppliers, venues, exhibitors, and attendees, and were especially damaging to small businesses, which make up 99% of industry companies and account for 80% of all event exhibitors. The alliance urged policymakers to adopt trade policies that increase affordability, reduce uncertainty, and improve competitiveness, including supporting free trade agreements and removing tariffs, subsidies, and non-tariff barriers with international trading partners.
In the Supreme Court’s 6–3 decision, justices held that IEEPA “does not authorize the president to impose tariffs,” effectively overturning the legal basis for the tariff measures. Former U.S. President Donald Trump defended his authority to set tariffs and criticized having to await the decision. The Court had heard arguments on the legality of these tariffs in November 2025.
The ruling is part of broader legal developments affecting U.S. tariff policy. The Supreme Court reaffirmed that tariff authority belongs to Congress, not the president, limiting executive power to impose sweeping tariff measures without explicit legislative authorization. This decision has global trade and constitutional implications.
